How Texas Foreclosure Filing Works
Notice of Sale (Foreclosure Posting)
Under Texas Property Code §51.002, before a foreclosure sale can occur:
- Notice of Default — The borrower must be in default under the deed of trust. Texas is a non-judicial foreclosure state; the lender or mortgage servicer can proceed without court involvement unless the borrower files a lawsuit.
- Notice of Sale Filed with County Clerk — At least 21 days before the sale, the substitute trustee files a copy of the notice of sale with the county clerk. This is the "foreclosure posting" published on county websites. The filing fee is typically $2-$12 per notice.
- Notice Posted at Courthouse — The notice is also physically posted at the county courthouse where the sale will occur.
- Notice Published in Newspaper — For homestead properties, the notice must also be published in a local newspaper once a week for three consecutive weeks before the sale.
What's in a Foreclosure Notice
Each notice typically contains:
- Property address and legal description — The full metes-and-bounds or lot/block legal description
- Deed of Trust information — Original date, recording number, and county where recorded
- Original principal amount — The loan amount at origination
- Current mortgage servicer — The company collecting payments and administering the foreclosure
- Noteholder / Mortgagee — The current owner of the promissory note
- Substitute Trustee — The law firm or trustee company appointed to conduct the sale
- Sale date, time, and location — Always the first Tuesday of the month, 10 AM - 4 PM
- Military service notice — Required notice about Servicemembers Civil Relief Act protections
